Soweit nicht ausdr\u00fccklich Gegenteiliges vereinbart wurde, gelten unsere, dem Vertragspartner bekannt gegebenen AGB. Die Vertragssprache ist Deutsch.<\/p>

PRICES AND SHIPPING COSTS<\/strong>

3. Die Preise basieren auf den Kosten zum Zeitpunkt der erstmaligen Preisangabe. Sollten sich die Kosten bis zum Zeitpunkt der Abgabe einer Bestellung durch den K\u00e4ufer ver\u00e4ndern, so ist das Weingut Johannes Schwarzl & MB berechtigt, die Preise entsprechend anzupassen.
4. Deliveries outside of Austria can only be made if there are no legal or disproportionate logistical obstacles to the delivery.
5. Alle durch den Versand entstehenden Kosten tr\u00e4gt der K\u00e4ufer. 6. Ab einem Bruttowarenpreis von EUR 150,- \u00fcbernimmt\u00a0 Schwarzl die Kosten der Standardzustellung innerhalb \u00d6sterreich.

F\u00fcr Sch\u00e4den und Beeintr\u00e4chtigungen welche w\u00e4hrend des Transportes entstehen, garantiert Schwarzl vollst\u00e4ndigen Ersatz unter folgenden Bedingungen: Die eintreffende Ware ist sofort auf Ordnungsm\u00e4\u00dfigkeit und Vollst\u00e4ndigkeit zu \u00fcberpr\u00fcfen und mitzuteilen. Jegliche Beanstandungen sind vom Transportunternehmen zu best\u00e4tigen.<\/p>

RETURN OF GOODS AND RIGHT OF WITHDRAWAL<\/strong>
1. Weingut Johannes Schwarzl & MB ist bis auf Widerruf bereit, bei ihr gekaufte Waren gegen Erstattung des vollen Kaufpreises unter folgenden Voraussetzungen zur\u00fcckzunehmen: Die R\u00fcckgabe muss innerhalb von 14 Tagen ab Rechnungsdatum originalverpackt, unbesch\u00e4digt und unter Vorlage der Originalrechnung erfolgen. Die R\u00fccknahme erfolgt zu dem zum Zeitpunkt des urspr\u00fcnglichen Kaufs g\u00fcltigen Preis. Die Erstattung des Kaufpreises erfolgt in Form einer Gutschrift.
2. Folgen des Widerrufs: Wenn Sie diesen Vertrag widerrufen, hat Schwarzl von Ihnen erhaltene Zahlungen, einschlie\u00dflich der Lieferkosten, unverz\u00fcglich und sp\u00e4testens binnen vierzehn Tagen ab dem Tag zur\u00fcckzuzahlen, an dem die Mitteilung \u00fcber Ihren Widerruf dieses Vertrags bei Weingut Johannes Schwarzl & MB eingegangen ist. Weingut Johannes Schwarzl & MB kann die R\u00fcckzahlung verweigern, bis die Waren bei Weingut Johannes Schwarzl & MB eingelangt sind oder bis Sie den Nachweis erbracht haben, dass Sie die Waren zur\u00fcckgesandt haben, je nachdem, welches der fr\u00fchere Zeitpunkt ist. Sie haben die Waren unverz\u00fcglich und in jedem Fall sp\u00e4testens binnen vierzehn Tagen ab dem Tag, an dem Sie Schwarzl \u00fcber den Widerruf dieses Vertrags unterrichten, an Weingut Johannes Schwarzl & MB, Ottenberg 32, 8461 Ehrenhausen zur\u00fcckzusenden oder zu \u00fcbergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von vierzehn Tagen absenden. Sie tragen die unmittelbaren Kosten sowie die Gefahr der R\u00fccksendung der Waren. Sie m\u00fcssen f\u00fcr einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Pr\u00fcfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zur\u00fcckzuf\u00fchren ist.<\/p>

ORDERS, DELIVERY PERIOD, DELIVERY OBSTACLES, WITHDRAWAL FROM THE CONTRACT<\/strong>
1. Die Bestellung des Kunden stellt ein Angebot dar. Ein Vertrag kommt erst nach Annahme von Schwarzl zustande. Der Kunde wird von unserer Annahme per E-Mail oder per Telefon verst\u00e4ndigt. Sollte Schwarzl der Bestellung des Kunden aus irgendwelchen Gr\u00fcnden nicht nachkommen k\u00f6nnen, wird der Kunde dar\u00fcber unverz\u00fcglich verst\u00e4ndigt.
2. Weingut Johannes Schwarzl\u00a0 & MB nimmt Auftr\u00e4ge \u00fcber den Internet-Onlineshop von Montag bis Freitag in der Zeit von 08.00 Uhr bis 17.00 Uhr entgegen. Sofern Auftr\u00e4ge au\u00dferhalb der Bestellzeiten eingehen, gelten diese erst am Beginn der Bestellzeit am n\u00e4chsten Werktag als zugegangen.
3. Bei Auftragserteilung hat der Kunde einen genauen Lieferort zu nennen. Der Kunde ist verpflichtet, die bestellte Ware am angegebenen Lieferort sicherzustellen. Schwarzl \u00fcbermittelt dem Kunden eine schriftliche (einschlie\u00dflich per E-Mail) Bestellbest\u00e4tigung mit allen relevanten Auftragsdaten.
4. Die Lieferung erfolgt \u00fcber einen von Weingut Johannes Schwarzl & MB beauftragten Versandpartner zu gesch\u00e4fts\u00fcblichen Zeiten.
5. Im Fall der Nichtannahme von bestellter Ware ist Schwarzl berechtigt, den Ersatz der dadurch entstandenen Mehraufwendungen, wie zB. frustrierte Transportkosten, zu verlangen. Dies gilt nicht, wenn Schwarzl ihre Leistungen nicht vertragsgem\u00e4\u00df erbringt.
6. Die Annahme von Bestellungen erfolgt unter Vorbehalt der Lieferm\u00f6glichkeiten. Schwarzl beh\u00e4lt sich vor, bei \u00dcberzeichnung eines Produktes den Bestellern auch geringere Mengen zuzuteilen. Wird die Lieferung oder die Einhaltung einer vereinbarten Lieferfrist durch von Weingut Schwarzl nicht zu vertretende Umst\u00e4nde unm\u00f6glich, so erlischt die Lieferpflicht zu dem vorgesehenen Liefertermin. Zu den von\u00a0 Schwarzl nicht zu vertretenden Umst\u00e4nden geh\u00f6ren insbesondere: Schwierigkeiten beim Bezug der Waren oder Vormaterialien von Dritten, bei Betriebsst\u00f6rungen, Verkehrsst\u00f6rungen, Aussperrungen und Streiks sowie alle F\u00e4lle h\u00f6herer Gewalt. Schwarzl wird in solchen F\u00e4llen den K\u00e4ufer unverz\u00fcglich kontaktieren, um einen Ersatztermin f\u00fcr die verhinderte Lieferung zu vereinbaren. Sofern dem K\u00e4ufer von Schwarzl ein neuer Liefertermin angeboten wird, der nicht sp\u00e4ter als zwei Wochen nach einem der urspr\u00fcnglich vereinbarten Liefertermine liegt, und die Lieferung zu diesem neuen Termin auch ordnungsgem\u00e4\u00df durchgef\u00fchrt wird, liegt eine rechtzeitige Lieferung durch Schwarzl im Sinne des Kaufvertrages vor.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t

7. In the case of divisible services, the buyer has no right of withdrawal with regard to parts that can be delivered, insofar as parts of the service can be performed and can be used by the buyer. Under the same conditions, or if the remaining parts can be delivered in good time, the buyer is not entitled to refuse partial deliveries.
8. If the buyer unjustifiably declares that he does not want to stick to the contract ("cancellation"), and Katharina Schwarzl agrees to this in writing (by e-mail), Katharina Schwarzl is entitled to 15% of the purchase price as flat-rate compensation ("cancellation fee "). In the case of ordered goods, such a contract termination is generally excluded. Deviating from this, the statutory rights of withdrawal without cancellation fee according to \u00a7\u00a7 5e - 5h of the Consumer Protection Act remain valid for consumers.
9. Changes or cancellations of orders by the buyer must always be made in writing (by e-mail). Katharina Schwarzl reserves the right to accept declarations in other forms, which then only become effective with written confirmation from Katharina Schwarzl (by e-mail).
10. Unless otherwise agreed, Katharina Schwarzl delivers within 3 to 5 working days after confirmation of the concluded contract.<\/p>

WARRANTY<\/strong>

2. Promises, such as the usability or special properties of the goods, or declarations by Katharina Schwarzl's employees are non-binding and do not represent an express assurance of specific properties if they are not made in writing (by e-mail).
3. Warranty claims presuppose that defects (e.g. a broken wine bottle) are reported to Katharina Schwarzl immediately, namely recognizable defects immediately upon acceptance, hidden defects after discovery, and with presentation of the opened goods and the original invoice.
4. A warranty claim is in any case limited to the purchase price of the delivered and defective goods.
5. Katharina Schwarzl fulfills her warranty obligations at her discretion either by delivering goods free of defects, improvement, subsequent delivery of missing quantities or cancellation of the contract (ie repayment of the purchase price) within a reasonable period of time.
6. For transactions with consumers within the meaning of the Austrian Consumer Protection Act, the customer can request improvement, replacement of the item, reasonable price reduction or conversion in the event of a defect at his own discretion and in compliance with the statutory provisions.
7. Reasons for taste, commercial or minor, technically caused deviations in quality, quantity, color, size, weight, equipment or design as well as age-related changes in taste, color and packaging do not constitute warranty defects or non-fulfillment of the contract.
8. Katharina Schwarzl is not liable for a match in terms of taste, colour, material and pattern or other matching features of goods that have been ordered. The same applies to goods ordered based on a sample, provided the deviation is within the customary and technical limits.<\/p>

\u00a0<\/p>

LIABILITY FOR DAMAGES<\/strong>
1. Katharina Schwarzl is liable for damages according to the legal regulations. However, liability for damage caused by slight negligence is excluded. The limitation of liability does not apply to damage resulting from injury to life, limb or health or to claims under the Austrian Product Liability Act.<\/p>

YOUTH PROTECTION<\/strong>
The sale and delivery of wine and spirits can only be made to persons over 18 years of age. In order to comply with legal regulations, Katharina Schwarzl is entitled to hand over goods only after legitimation by means of an official photo ID. In the event of a justified refusal to hand over the goods, the customer is obliged to compensate for the damage actually incurred (e.g. delivery costs).
By placing the order, the customer assures that he or the recipient of the goods is older than 18 years.<\/p>

IT PROCESSING AND CUSTOMER DATA<\/strong>
The buyer agrees that the personal data specified in the purchase contract and disclosed during registration will be stored and processed in compliance with the provisions of the Data Protection Act. This data is used to the extent necessary to comply with legal regulations, to process payment transactions, customer care and marketing purposes. Furthermore, the customer agrees to receive mailings from Katharina Schwarzl for advertising purposes. This consent can be revoked at any time by sending an email to Katharina Schwarzl (delikatessen@gutschwarzl.at). As part of customer care, Katharina Schwarzl's data will not be passed on to other companies.<\/p>

OTHER PROVISIONS<\/strong>
1. If individual provisions of the contract or these general terms and conditions are invalid, this does not result in the invalidity of the entire contract or the entire general terms and conditions. The remaining content of the contract and the remaining General Terms and Conditions remain unchanged.
2. The place of performance for both Katharina Schwarzl and the buyer is Katharina Schwarzl's business address.
3. The competent court in Leibnitz has exclusive jurisdiction to decide all disputes arising in connection with the contractual relationship.
4. The contract is subject to Austrian law.<\/p>
